This is addressed in the Neighbourhood Disputes Resolution Act 2011, and put simply is as follows—if the neighbour indicates that they know where
the true boundary is and that, once surveyed, this position is confirmed as
being correct, then they are not required to contribute towards the cost of the
survey. If the position that they indicated was incorrect, then the surveying
costs should be shared equally.
